These Terms of Service ("Terms") govern your access to and use of the website brotherscapital.in and the services provided by Brothers Capital ("we", "our", "the firm"). By engaging us or using our website, you agree to these Terms.
1. Scope of services
Brothers Capital provides services in four broad areas:
- Legal — document drafting, agreements, affidavits, notarisation, registry, certificate applications.
- Chartered Accountancy — GST, ITR, accounting, company registration, MSME, NGO registration and related filings.
- Document & digital — government IDs, licences, online registrations, website & digital marketing.
- Insurance — life, health, term, vehicle and commercial insurance distribution.
The exact scope for each engagement will be confirmed in writing (over email or WhatsApp) before work begins.
2. Fees and payment
- All fees are quoted upfront and remain fixed for the agreed scope. No hidden charges.
- Government fees (stamp duty, registration fees, e-stamp charges, statutory filing fees) are pass-through and shown separately on your invoice.
- Fees are payable in advance for one-time services. Monthly retainers are billed at the start of each month.
- Insurance premium is paid directly to the insurer; we do not handle premium collection.
- Accepted payment methods: UPI, IMPS, bank transfer, cash (with receipt), and selected card payments.
3. Client responsibilities
For us to deliver your engagement properly, you agree to:
- Provide accurate, complete and truthful information and documents.
- Share the documents we ask for in a timely manner.
- Respond promptly to OTPs, e-verifications and clarification requests.
- Disclose all relevant facts — withholding information that affects the work may lead to rejected applications or rework charges.
- Pay applicable fees on the agreed schedule.
4. What we do not guarantee
While we do our best to deliver every engagement successfully and on time, we cannot guarantee outcomes that depend on government departments, third parties or factors outside our control. Specifically:
- We cannot guarantee approval timelines for government applications (passport, FSSAI, GST, Aadhaar, registry, etc.).
- We cannot guarantee that an application will be approved — only that it is filed correctly and complete.
- Insurance claim settlements are decided by the insurer, not by us.
- Tax assessment outcomes are decided by the Income Tax Department.
5. Refunds
- Service not started — full refund within 7 days.
- Service in progress — pro-rata refund based on work completed; government fees already paid are non-refundable.
- Service completed — no refund, but we will re-file rejected applications free of professional fee where the rejection is due to an error on our side.
6. Confidentiality
All information and documents you share with us are held in strict confidence. We do not share your data with third parties except as required to deliver the service or as required by law. See our Privacy Policy for details.
7. Intellectual property
All content on this website — text, images, branding, design — is the intellectual property of Brothers Capital, except where third-party logos (e.g. Swiggy, Zomato, FSSAI) are used for illustrative purposes. You may not reproduce or distribute our content without written permission.
8. Limitation of liability
To the maximum extent permitted by law, our total liability for any claim arising from an engagement is limited to the professional fee paid for that engagement. We are not liable for indirect, consequential or punitive damages.
9. Termination
Either party may terminate the engagement at any time with reasonable notice. On termination, you receive:
- All documents you have shared with us, returned within 7 working days.
- A pro-rata refund for unutilised fees (see Refunds above).
- A handover note of the work done so far.
10. Communication
Our preferred communication channels are WhatsApp, email and phone. Instructions given over WhatsApp are treated as written and binding. Please confirm any sensitive instruction over email if you want a clearer audit trail.
11. Governing law & jurisdiction
These Terms are governed by Indian law. Any dispute will first be attempted to be resolved through mediation in good faith. If unresolved, the courts of Ghaziabad, Uttar Pradesh shall have exclusive jurisdiction.
12. Changes to terms
We may update these Terms from time to time. The "Last updated" date at the top reflects the latest revision. Continued use of our services after a change constitutes acceptance of the new terms.
